General terms and conditions of business

For 2023, the following applies to all sales in the online shop: By placing an order for VAT-exempt deliveries, you confirm that you meet the following conditions:
- The ordered components are used to operate a photovoltaic system whose installed gross power is not or will not be more than 30 kW (peak) according to the market master data register.
- The PV system is connected to the public power grid.
- You purchase the items for your own new system or for replacing or expanding your existing PV system.
- They do not engage in commercial resale.
- Your PV system is or will be a permanently installed system and is not a mobile device.
- Your PV system is set up "close to home" on or next to a residential building.
- The system will be installed in Germany (further transport abroad and installation there is not permitted).
You confirm that if you become aware of incorrect information, the regular VAT of 19% must be recalculated.
We reserve the right to check every order and, in the event of doubt or obvious deviations from the conditions, to refuse orders or to adjust them accordingly after consultation with the customer.
Please note that there may be changes or adjustments to the procedure over the course of the year due to further instructions from authorities and the legislature. We reserve the right to make appropriate adjustments to our processing procedure.
After successful registration in the market master data register, please send us the registration number without being asked. If we do not receive this proof from you, we reserve the right to demand VAT from you.
§ 1 Scope of the contract
The following general terms and conditions regulate the contractual relationship between the seller Titan Solar GmbH - Ebay name "titansolar" and the respective buyer on the eBay sales platform on the Internet or our web shop www.titansolar.de
§ 2 Subject of the contract
The subject of the respective contract is the sale of goods by the seller to the buyer on the eBay sales platform, in particular the sale of PV systems and accessories as well as electronics.
These goods are offered by the seller either via this online shop or the eBay shop as shop items or as general auction items. General auction items are visible both on the general eBay websites and in the seller's eBay shop. The goods offered on the general eBay websites or in the seller's eBay shop are binding offers by the seller to conclude a purchase contract for the respective item.
§ 3 Conclusion of contract, contract language
The buyer can buy the goods offered via the online shop or the seller's eBay shop immediately or bid on these goods in an auction. Auction listings may also include a Buy It Now option. The goods offered in the seller's eBay shop in the Buy It Now offer format and auctions of these goods are also visible on the general eBay websites. This does not apply to the seller's shop items.
In the case of a buy-it-now, an effective purchase contract for a buy-it-now price (fixed price) is concluded between the buyer and seller when the buyer clicks on the "Buy it now" or "It's now & new" button and then confirms it. In the case of fixed-price items for which the seller has selected the "immediate payment" option, the buyer accepts the offer by clicking on the "Buy it now" button and completing the immediately subsequent payment process. The buyer can also accept offers for several items by placing the items in the shopping cart (if available) and completing the immediately subsequent payment process. The buyer can also buy listings with the "Buy It Now" option as a guest without having to log in to eBay. In this case, the buyer accepts the offer by clicking the "Buy it now" button, selecting the "Continue as guest" option on the following login page and completing the payment process that follows immediately.
In an auction, a valid purchase contract is concluded with the buyer who has submitted the highest bid within the bidding period. The amount of the purchase price is based on this highest bid. A bid expires if another buyer makes a higher bid during the offer period.
If an auction offer is also provided with the Buy It Now option, an effective purchase contract for the purchase of the item is already concluded at the Buy It Now price (fixed price) regardless of the end of the offer period and without an auction being held if a buyer exercises this option. The option can be exercised by the buyer as long as no bid has been placed on the item or a minimum price set by the seller has not yet been reached.
If the seller provides his offer with a price suggestion function, the buyer and seller can negotiate the price for this item. The submission of the price proposal by the buyer is then to be seen as the binding offer and the seller's agreement to the price proposal as the binding acceptance of the seller.
After conclusion of the contract, the seller sends the buyer a confirmation and information on the purchase process via eBay.
Contract language is exclusively German. The text of the contract is not saved by the seller and can no longer be called up after completing an order process (e.g. “Buy it now”). However, the buyer can save or print out the order data immediately before sending it using the functions of his browser.
§ 4 Right of Withdrawal
If the buyer is a consumer, he is legally entitled to a 14-day right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
Information on the right of withdrawal can be found in the seller's respective item description. After the conclusion of the contract, the buyer also receives an order confirmation with information about his right of cancellation and information on how to exercise it, e.g. using the model cancellation form attached to the cancellation policy.
§ 5 Warranty, Liability
The seller's warranty in the event of a defect in the goods and the seller's liability for damages are based on the statutory provisions.
§ 6 Final Provisions
German law, to the exclusion of the UN Sales Convention, applies exclusively to these General Terms and Conditions and to the sales contract concluded in each case. In the event that the buyer is a consumer, this only applies insofar as the protection provided by mandatory provisions of the law of the state in which the consumer has his habitual residence is not withdrawn.
Should one or more clauses of these terms and conditions be wholly or partially invalid, this shall not affect the validity of the remaining provisions.
§ 7 Information on alternative dispute resolution
The EU Commission provides an online platform for dispute resolution ("OS platform"), which can be reached via the link http://ec.europa.eu/odr. If the customer is a consumer living in the European Union, it is possible to use this platform to settle disputes about contractual obligations arising from online sales contracts out of court.
The seller is not obliged and fundamentally unwilling to participate in a dispute settlement procedure before a consumer arbitration board.
§ 8 Guarantee conditions Germany:
The Low Voltage Connection Ordinance (NAV) stipulates that electrical installations that are connected to a connection to the public electricity supply network may only be carried out by a specialist.
In addition, every electrical system must be approved by a qualified electrician as part of the VDE regulations. This procedure is carried out according to the corresponding VDE test standards, is legally binding and is linked to a measurement and acceptance report.
Electrical installations that are carried out improperly can lead to overvoltages, electric shocks, short circuits or cable fires. In an emergency, there is a risk of fatal injury for third parties or there may be considerable damage to property.
Anyone who takes the electrical installation into their own hands when building a house is fully liable for any damage incurred as a result. This applies not only to the personal injury and damage to property mentioned, but also to services provided by manufacturers.
If, for example, there are defects in electrical appliances in the household that can be traced back to improper electrical installation, the manufacturer's guarantee for the product concerned also expires.

(2) ....The work may only be carried out by an installation company entered in a network operator's installer directory; In the interests of the connectee, the network operator may only make an entry in the installer directory dependent on proof of sufficient professional qualifications to carry out the respective work.
Law on the Regulation of Crafts (Crafts Code) § 7 (excerpt)
(1) A natural or legal person or a partnership is entered in the register of crafts as the owner of an operation of a craft that requires a license if the manager meets the requirements for entry in the register of crafts with the craft to be operated or a craft related to this.
(1a) Anyone who has passed the master craftsman's examination in the craft to be operated or in a related craft that requires authorization is entered in the register of craftsmen.
